Are bongs legal in Brisbane? It depends on who you ask, the buyer or the seller, because Queensland treats the two very differently from the rest of Australia. At The Bong Shop, we've supplied Australian smokers for more than 40 years, and this is one of the most common questions we get from Queensland customers. The quick response is that there is nothing wrong with having a bong of your own. The laws in Queensland make it illegal to operate a business dealing with selling, supplying, and keeping bongs, which alters the way you purchase them from the Internet in Brisbane.
Is It Legal to Own a Bong in Queensland?
Yes. Queensland's Tobacco and Other Smoking Products Act 1998 doesn't stop an adult from owning a bong for personal use. The law is aimed at businesses, not individual smokers.
This surprises a lot of people searching "bongs Queensland" online. Most assume the ban covers everyone. In our experience, the confusion usually clears up once people understand the law targets retail supply, not personal possession.
Why Queensland's Bong Laws Are Different
The sale, supply, display and storage of bongs by businesses has been banned in Queensland since 2005. This was made stricter in 2007 to include bong accessories as well, since some business owners attempted to circumvent the ban through accessories.
In November 2025, Queensland Parliament passed further amendments. The updated law now also covers possession as part of a business activity, not just sale and display. Businesses caught breaching it face a maximum penalty of 140 penalty units, which works out to more than $24,000 at current rates.
This puts Queensland well ahead of most other states. Victoria only banned bong sales from 2012. New South Wales and South Australia regulate them more loosely, often just requiring labelling for tobacco use.
What This Means When You Buy Bongs Brisbane Wide
Because Queensland's law targets the seller rather than the buyer, the real question for Brisbane shoppers isn't "can I own one." It's "can a retailer legally sell and ship one to me."
This is why some online stores list water pipes as ornamental glass, or skip Queensland delivery altogether. Others limit what they display or advertise to Queensland addresses. None of this means buying online is unsafe. It just means the retail side of the bong market works differently here than it does interstate.
If you live in Brisbane and shop for bongs online, check a retailer's shipping and product policy before you order. Don't assume normal interstate shipping rules apply, because in Queensland, they often don't.

Conclusion
While buying a bong for personal use is not illegal in Brisbane, the laws in the state of Queensland are more restrictive than any other state in Australia concerning the sale and supply of the product. Therefore, one should ensure that the retailer is open and honest about the impact of the regulations on the transaction.
