Should You Commence a Court Case Without Legal Assistance?

Good morning, “I’ve started a court case and I need help.” Whilst you are able to commence a court case without legal assistance you must be very careful. I have recently had several clients commence court case without obtaining legal advice beforehand. They have relied on their sense of injustice to proceed to recover debts which they are owed. There are at least two sides to every story. Going to the court must always be the last resort where you never know what may be revealed and how the court may consider your case. There are important considerations:

1. Are you in time or is there a limitation period?
2. Do you have the necessary evidence as required by the Evidence Act?
3. Are you recovering from the correct party?
4. Can it be calculated in dollar value or not?
5. Do you have evidence either physical or electronic or is it just one person’s word against another?
6. Is your loss worth the stress, time and money required to pursue your case in court?

Court proceedings usually consume large amounts of time, money and stress and without proper preparation, the result may well be that your case can flounder and you can be subjected to paying the defendant’s legal costs. For the uninitiated, it can be like walking into a quagmire. That’s what happened to my clients. In one case I was able to bring the case back on track and identify the correct debtor and establish the required evidence to proceed. In the other case, I was able to negotiate a settlement and minimise my client’s losses in a situation where winning was not possible.
